1. Who we are
Altless ("we", "us") is operated by:
- Trader: [to be added], a sole trader (empresário em nome individual) established in Portugal
- Tax identification number (NIF): [to be added]
- Registered address: [to be added]
- Email: [to be added]
- Website: [to be added] (the "Site")
2. These Terms
These Terms of Service (the "Terms") are a contract between you and us. They govern your use of the Site, the Altless desktop application for Windows (the "App"), and the services available through them (together, the "Service"). The following documents are part of these Terms:
- our Privacy Policy;
- our Refund and Cancellation Policy;
- the plans, packs and prices shown in the App, on the Site and at checkout at the time of purchase.
By creating an account, making a purchase or using the Service you agree to these Terms. If you do not agree, do not use the Service.
Consumers. If you are a consumer (a natural person acting for purposes outside your trade, business or profession) you benefit from mandatory consumer-protection rules of the country where you live. Nothing in these Terms limits those rights. Where these Terms conflict with such rules, the rules prevail.
Language. These Terms are concluded in English.
3. Eligibility and accounts
3.1 Age. You must be at least 18 years old and of the age of majority where you live to use the Service. The Service is not directed at, and may not be used by, anyone under 18. When you first sign in, we ask you to confirm your age by giving your date of birth; if it shows that you are under 18, you cannot use the Service. Giving a false age is a breach of these Terms: if we find out that you are under 18, or that you gave a false age, we will close your account and delete your data (see 3.4 and the Privacy Policy).
3.2 Sign-in. You sign in with an email account (through our authentication provider, Clerk) or with your Steam account. Signing in with Steam does not replace the age confirmation in 3.1: you must confirm your age whichever way you sign in. You are responsible for keeping your login credentials and devices secure and for everything that happens under your account. Tell us immediately at [to be added] if you suspect unauthorised use.
3.3 One person, one account. Accounts are personal. You may not share, sell or transfer your account, run several accounts to obtain the Trial Pack or other limited offers more than once, or use automated means to create accounts.
3.4 Deleting your account. You can delete your account at any time from the App or by emailing us. Deletion works as follows:
- your account is deactivated immediately, any active subscription is cancelled immediately, and your remaining Sparks balance is forfeited. We do not refund the unused remainder of the paid period or the unspent Sparks, unless a statutory right applies (see the Refund and Cancellation Policy);
- your data is permanently erased 30 days later, except for records we must keep by law (see the Privacy Policy);
- a deleted account cannot be restored or signed into again. If you later sign in with the same Steam account, a new, empty account is created, without any previous purchases, balance, memory or history; a Trial Pack already used with that Steam account stays used (see 6.2).
4. What the Service is — and an important note about AI
4.1 Description. Altless is an AI companion for video games. It answers questions about games in text and by voice, can search the internet for up-to-date information, and keeps a memory of facts about you and of past conversations so that it can personalise its answers. Altless may run as an overlay on top of your game.
4.2 You are talking to an AI. Altless's answers are generated by artificial-intelligence models operated by third-party providers (see the Privacy Policy for the list). Altless is not a human.
4.3 Answers can be wrong. AI-generated answers can be inaccurate, incomplete, outdated or misleading, even when they sound confident. Game content changes with patches and regional versions. Do not rely on Altless's answers for anything where an error could cause harm, including decisions involving money, health, safety or legal matters. Always check important information against the game itself or the publisher's official sources. We do not guarantee any particular result, hint or outcome in your game.
4.4 Not affiliated with game publishers. Altless is an independent product. It is not endorsed by, sponsored by or affiliated with Valve Corporation, any game developer or publisher, or any other third party mentioned in the Service. Game titles, characters and other names are trademarks of their respective owners and are used only to identify the games you ask about.
4.5 Your games' rules still apply. You are responsible for making sure that your use of Altless (for example, running an overlay, or asking for help in competitive play) complies with the rules of the game and platform you are playing on. Some games, tournaments or anti-cheat systems restrict overlays or third-party assistance. Altless does not read game memory or inject code into games, but we cannot guarantee that every game or anti-cheat system will accept it. Use of Altless alongside a game is at your own risk.
4.6 Internet search and third-party content. When Altless searches the internet or uses game databases, it relies on third-party content that we do not control and that may be inaccurate or subject to its owners' rights. We provide links and summaries for your convenience only.
5. Sparks
5.1 What Sparks are. "Sparks" are prepaid usage units that are consumed when you use the Service (for example, when Altless answers a question, listens to your voice, speaks, searches the web or updates its memory). Sparks are a licence to use the Service; they are not money, a currency, a deposit, an investment or property. They have no cash value, cannot be transferred to another account or person, cannot be sold or exchanged, and cannot be converted back into money except where a refund is due under the Refund and Cancellation Policy or applicable law.
5.2 How Sparks are charged. The cost of each action in Sparks depends on its length and complexity and on the models and tools used. Before performing an action, Altless reserves an estimated maximum number of Sparks; when the action completes, the actual cost is charged and any unused part of the reservation is returned to your balance. The App shows you your balance and the cost of each action. We may change the Sparks cost of individual actions as the cost of the underlying technology changes; changes do not affect Sparks already charged.
5.3 Negative balance. To avoid cutting off an answer midway, we may let your balance go negative by the amount of the overrun. Any such shortfall is deducted automatically from your next Sparks credit (renewal, pack or other grant). While your balance is negative, Altless will not perform further paid actions.
5.4 No free tier. The Service does not include a free plan or free daily Sparks. Without a positive Sparks balance, Altless will decline paid actions and offer you a way to top up.
5.5 Expiry. Sparks do not expire. Sparks granted with a subscription are not forfeited at the end of a billing period: they accumulate while your subscription is active and remain on your balance after the subscription ends. The same applies to Sparks from Packs and the Trial Pack. Sparks are lost only in the cases described in these Terms, for example when your account is deleted (3.4) or when a refund removes the Sparks that came with a payment (see 10.3).
5.6 Promotional Sparks. Sparks granted free of charge (promotions, compensation, promo codes) are subject to the conditions stated when granted, have no cash value and are never refundable.
6. Plans, Trial Pack, Packs and prices
6.1 Subscriptions. We offer monthly subscription plans that renew automatically until cancelled. Each plan includes a set number of Sparks per month. The plans currently on sale, their prices and the Sparks they include are shown on the Billing page of the Site (after you sign in), in the App and at checkout.
6.2 Trial Pack. A one-time Trial Pack with a small amount of Sparks at a low price is available once per account and once per Steam account, whether you buy it on the Site or in Steam. It does not renew. Attempts to obtain more than one Trial Pack (for example, by creating several accounts) may lead to suspension of the accounts involved.
6.3 Sparks Packs. On the Site, you can buy additional one-time packs of Sparks while you have an active subscription; packs cannot be bought on the Site without one. In Steam, Sparks are sold as one-time packs (see 7.6).
6.4 Prices and taxes. Prices are listed in US dollars. Sales tax, VAT, GST or similar taxes are added at checkout based on your billing country and shown before you confirm the purchase, unless the checkout page states that tax is included. Where supported, the checkout may offer to show the price in your local currency; the conversion rate is set by the payment provider and shown to you before you pay. The price in effect is the one displayed at checkout at the moment of purchase.
6.5 Price changes. We may change prices and the Sparks included in each plan. For an existing subscription, a price change takes effect only from the next renewal that falls at least 30 days after we notify you by email or in the App. If you do not agree, cancel before the renewal; your subscription then ends at the end of the current period.
7. Payments and the merchant of record
7.1 Payment processing. Purchases on the Site are processed through Stripe Managed Payments. For these transactions, Sold through Link, LLC, an affiliate of Stripe, Inc. ("Link"), acts as the merchant of record: it charges your payment method, issues your receipt or invoice, calculates, collects and remits the applicable taxes, processes refunds and handles payment disputes. Your bank or card statement will show a descriptor beginning with "LINK.COM*".
7.2 Your contract with us. The product you buy — access to the Service and Sparks — is licensed and supplied by us under these Terms. We remain responsible for the Service, its content and product support. Link is responsible for the payment transaction. When you pay, you also accept Link's payment terms shown at checkout.
7.3 Managing payments. You can view your orders, update your payment method, and cancel or change your subscription on the Billing page of the Site, or through your Link account at link.com. Payment and subscription support is also available from Link support; product support is available from us at [to be added].
7.4 Authorisation. By subscribing you authorise the merchant of record to charge your payment method for the plan price, which includes applicable taxes, at the start of each billing period until you cancel. By buying a Trial Pack or Sparks Pack you authorise a one-time charge.
7.5 Failed payments. If a renewal payment fails we (or Link) may retry it and notify you. If the payment still cannot be collected, your subscription is cancelled and your access to paid features ends. Sparks already granted for a period that is later unpaid or refunded are removed (see 10.3).
7.6 Purchases in Steam. If you buy Sparks inside Steam, the payment is made to and processed by Valve through Steam under the Steam Subscriber Agreement, and refunds of Steam purchases follow Steam's refund rules. The Sparks themselves are supplied by us under these Terms.
8. Automatic renewal, cancellation and plan changes
8.1 Consent. Before you pay, the price, the billing period, the automatic renewal, the renewal price and how to cancel are shown next to the purchase button on the Site and in the App. At checkout you are asked to tick a box confirming that you accept these Terms, under which your subscription renews automatically every month at the price shown until you cancel. You cannot subscribe without ticking it.
8.2 Cancellation. You can cancel at any time on the Billing page of the Site or through Link. Cancellation takes effect at the end of the current paid period; you keep access and your Sparks until then, and you are not charged again. We do not refund the remaining part of a period except as set out in the Refund and Cancellation Policy or where the law requires.
8.3 Upgrades (to a plan with more Sparks) take effect immediately and start a new monthly billing period on the day of the upgrade: you are charged the new plan's full monthly price minus a credit for the unused part of your current period, and you receive the new plan's Sparks minus the Sparks that correspond to that credit (Sparks you already have are kept). You upgrade in the Altless app or on the Billing page. Before paying you must tick a box asking us to start immediately and confirming that you pay for the Sparks you spend and lose the right of withdrawal once all Sparks are spent. The credit is based on the regular price of your current plan, even if you paid a discounted price for it. Your subscription then renews every month on the day of the upgrade. Downgrades take effect at the end of the current period; you start them in the Altless app or on the Billing page and confirm them on a Stripe page. Details are in the Refund and Cancellation Policy.
8.4 Reminders. We or Link will email you before certain renewals as required by law in your country. Keep your email address up to date.
9. Right of withdrawal (consumers in the EU/EEA and the UK)
9.1 The right. If you are a consumer in the European Union, the European Economic Area or the United Kingdom, you have the right to withdraw from a purchase made on the Site or in the App within 14 days of the day the contract is concluded, without giving any reason. To meet the deadline it is enough to send your statement before the 14 days expire. For purchases made in Steam, use Steam's refund process (see 7.6).
9.2 Starting immediately. Sparks and access to the Service are a digital service that starts as soon as the Sparks of a purchase are credited. The following applies only if, before the supply begins, you have expressly requested that we start immediately and acknowledged the rules below. You do this before you pay, on the Billing page of the Site or in the App, by ticking the box next to the buy button: “Start now; I understand I pay for Sparks I spend and lose the right of withdrawal once all Sparks are spent.” Where yearly plans are offered and you view the yearly prices, the box next to the plans reads instead: “I ask you to start the service now. If I withdraw within 14 days, I pay for the Sparks I have spent.” Sparks Packs and the Trial Pack each have a box of their own next to their buy buttons, always with the first wording. You cannot buy without ticking the box for that purchase. Then:
- Spent Sparks are paid for, unspent Sparks are refunded. If you withdraw, we return the price of the Sparks of the purchase you have not spent; the Sparks you have spent are kept at the price of one Spark of the purchase. The price of one Spark of a purchase is the amount you paid for it divided by the number of Sparks it gave you. Examples are in section 6 of the Refund and Cancellation Policy.
- The right is lost when all Sparks are spent. You lose the right of withdrawal once all Sparks are spent: when every Spark of the purchase has been used, the service has been provided in full.
- Subscriptions. Each plan's monthly price is the price of its Sparks, credited in full at the start of each period; access to the app is included at no separate charge. The rules above apply to the first period, to each renewal and to an upgrade, each as a purchase of its own.
- Yearly plans (where offered) are bought with the yearly wording of the box. Their Sparks are credited month by month, so the right is not lost by spending them: if you withdraw within 14 days, you pay for the Sparks you have spent, and we handle withdrawals from yearly plans individually. A Sparks Pack or the Trial Pack follows the rules above whichever wording of the box it was bought with.
For a purchase covered by 9.3 — a Sparks Pack, the Trial Pack or the first period of a plan: if you did not tick the box, or if the confirmation of the purchase was not emailed to you before its Sparks were credited, your right of withdrawal under 9.1 is not limited in this way: if you withdraw within 14 days, we refund the full amount you paid, and only the unspent Sparks of the purchase are removed from your balance.
9.3 Confirmation by email. Before we credit the Sparks of a Sparks Pack, of the Trial Pack or of the first period of a plan bought on the Site or in the App, we email a confirmation of the purchase to your account email. It repeats the box you ticked and the rules of 9.2. This step does not apply to renewals and upgrades: a withdrawal from a renewal is handled as described in section 6.5 of the Refund and Cancellation Policy, and an upgrade follows 8.3 and section 5 of that policy.
9.4 How to withdraw. Sign in on the Site, open the Billing page and use the link “Withdraw from contract here” at the bottom of the page: choose the purchase, check your name and press “Confirm withdrawal”. You can also send us a clear statement by email to [to be added], for example with the model withdrawal form below, but you do not have to use the form. After we receive your statement, we email an acknowledgement to your account email with the text of the statement and the date and time we received it.
9.5 Subscriptions: automatic renewal. If you submit a withdrawal statement for a subscription, we switch off its automatic renewal. You keep access and the period's Sparks until the end of the paid period, unless the payment for the period is refunded; then the subscription is cancelled at once. Cancelling a subscription (8.2) is a separate action: it stops the renewal and is not a withdrawal.
9.6 Refund mechanics. When we carry out your withdrawal, the unspent Sparks of the purchase are removed from your balance first. The refund is then made to the original payment method by the merchant of record without undue delay and no later than 14 days after we receive your withdrawal statement.
9.7 When we do not start a new purchase. We do not start a new purchase on the Site or in the App (purchases in Steam are not affected): (a) while the email address of your account does not accept our emails — for example, after a spam complaint or when the mailbox refuses them — because we could not send you the confirmation of the purchase; write to [to be added] to resolve it; or (b) after a documented abuse of the purchase-confirmation procedure, for example when a confirmation was not accepted because of the address, the Sparks were spent and a full refund was taken. If a payment is nevertheless made in case (b), we do not credit the Sparks and we refund the full amount. A withdrawal statement on its own is never a reason for either.
10. Refunds
10.1 Our refund rules are in the Refund and Cancellation Policy, which is part of these Terms. In short: used Sparks are not refundable except where the law says otherwise; unused purchases can be refunded within the withdrawal period; we handle accidental renewals and genuine problems case by case.
10.2 Link refunds. The merchant of record may, in certain cases, refund a transaction directly at your request within 60 days of purchase, including to avoid a payment dispute.
10.3 Refunds remove Sparks. Whenever a payment is refunded, reversed or charged back — by us, by Link, by Steam or by your bank — the Sparks granted for that payment are removed from your balance. If you have already spent them, your balance becomes negative and is settled from your next credit (see 5.3). A refund after a withdrawal under section 9 removes only the unspent Sparks of the purchase. We may suspend paid features until a negative balance caused by a refund or chargeback is settled.
11. Acceptable use
You agree not to, and not to help anyone else to:
- use the Service for anything illegal, or to harass, threaten, defame or harm others;
- use the Service to create or spread malware, cheats, exploits or tools that violate a game's terms or anti-cheat rules, or to gain unfair advantage in a way the game prohibits;
- try to extract the system prompts, model weights, training data or source code of the Service or of the AI models behind it, or to bypass its safety, rate or cost limits;
- access the Service by automated means (bots, scripts, scraping) or through anything other than the official App and Site, or resell, sublicense or share access or Sparks;
- obtain Sparks, the Trial Pack, promotions or refunds by fraud, including by using several accounts, stolen payment methods or false chargebacks;
- upload content that infringes someone else's intellectual-property or privacy rights, or that is sexually explicit involving minors, hateful or otherwise prohibited by our AI providers' usage policies;
- interfere with the Service's operation or security, or probe it for vulnerabilities without our written permission.
We may remove content, limit features, suspend or terminate accounts that break these rules, and we may report illegal activity to the authorities.
12. Your content, Altless's memory and AI output
12.1 Your content. You keep all rights to what you type or say to Altless ("Input"). You grant us a worldwide, non-exclusive, royalty-free licence to store, process, transmit and display your Input and the resulting conversations as needed to run, secure and improve the Service and to comply with law. We do not sell your content and we do not use it to train AI models.
12.2 Memory. Altless keeps a memory of facts about you and summaries of past conversations to personalise its answers. You can review and delete memory items and remove conversations from your history in the App, and deleting your account erases them.
12.3 Output. Subject to these Terms, you may use the answers Altless gives you ("Output") for your personal, non-commercial purposes. Output may be similar to output given to other users and may contain third-party material (quotations, game data, search results) that remains the property of its owners. We do not claim ownership of Output, but we make no promise that it is original, accurate or free of third-party rights.
12.4 Feedback. If you send us suggestions, you allow us to use them without obligation to you.
13. Our intellectual property and third-party services
13.1 The Service — including the App, Site, Altless's name, logo, voices, characters, design and software — is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable licence to install and use the App on devices you control for your personal use, in accordance with these Terms. You may not copy, modify, distribute, reverse engineer or create derivative works of the Service, except where the law allows it regardless of this clause.
13.2 Steam. Steam sign-in and game data are provided through Valve's Steam Web API. Steam data is provided to you "as is", "with all faults" and "as available", without warranties of any kind from Valve or from us; Valve is not a party to these Terms and has no obligations to you under them. Steam and the Steam logo are trademarks of Valve Corporation.
13.3 Game data and search. Game metadata comes from IGDB (a Twitch/Amazon service) and from Steam; web search results come from third-party search providers. Their content belongs to their respective owners.
13.4 Copyright complaints. If you believe content in the Service infringes your copyright, email [to be added] with the details of the work, the location of the material and your contact information. We will remove infringing material and may terminate repeat infringers.
14. Changes to the Service and to these Terms
14.1 Changes to the Service. We constantly develop Altless and may add, change or remove features, models, voices and supported games. Where a change negatively affects your access to or use of a paid feature in more than a minor way, we will tell you in advance by email or in the App, with a clear description of the change and its timing. If you are a consumer in the EU/EEA you may then terminate your subscription free of charge within 30 days of the notice (or of the change, if later) and receive a prorated refund of the unused period.
14.2 Beta features. Features labelled beta, preview or experimental may be less reliable, may be withdrawn at any time and may cost a different number of Sparks.
14.3 Changes to these Terms. We may update these Terms, for example because of new features, legal requirements or changes in our providers. We will post the new version on the Site with a new effective date and, for material changes, notify you at least 30 days in advance by email or in the App. If you do not agree, cancel your subscription and stop using the Service before the change takes effect; continued use after that date means you accept the new Terms. Changes do not apply retroactively to purchases already made.
15. Legal guarantee of conformity (consumers)
If you are a consumer in the EU/EEA, we are liable under the law for any lack of conformity of the Service with the contract during the subscription period (for a digital service supplied in a single act, such as Sparks Packs: for a lack of conformity existing at the time of supply, for at least two years). If the Service does not conform, you are entitled to have it brought into conformity, to a proportionate price reduction, or to terminate the contract, under the conditions set by law. To make a claim, email [to be added] with a description of the problem. These Terms do not limit your statutory rights.
16. Disclaimers and limitation of liability
16.1 Nothing in this section limits or excludes any liability that cannot be limited or excluded by law — including our liability for death or personal injury caused by negligence, for fraud or wilful misconduct, for gross negligence where the law prohibits exclusion, or under mandatory consumer-protection and product-liability law. Consumers' statutory rights (section 15) are not affected.
16.2 "As is", except for consumers' statutory rights. Beyond our statutory obligations, the Service is provided as is and as available. We do not promise that it will be uninterrupted, error-free, compatible with every game or system, or that its answers will be accurate or fit for any particular purpose (see section 4).
16.3 Cap. Subject to 16.1, our total liability to you for all claims arising out of or in connection with the Service in any 12-month period is limited to the amount you paid us for the Service in those 12 months.
16.4 Excluded losses. Subject to 16.1, we are not liable for indirect or consequential losses, loss of profit, loss of data (where you could reasonably have backed it up), or losses caused by third-party services, your games, your hardware or your internet connection, or by your breach of these Terms.
17. Suspension and termination
17.1 By you. You can stop using the Service at any time, cancel your subscription (section 8) and delete your account (section 3.4).
17.2 By us. We may suspend or terminate your access, with notice where reasonably possible, if you materially breach these Terms, if required by law or a payment provider, if your account is used for fraud or abuse, or if we discontinue the Service. If we terminate for a reason other than your breach, we refund the unused part of your current subscription period and any unspent Sparks Packs on a prorated basis. If we terminate for your breach, no refund is due for spent Sparks; the treatment of unspent Sparks follows the Refund and Cancellation Policy.
17.3 Discontinuation. If we decide to shut down Altless, we will give you at least [to be added] days' notice by email and in the App, stop renewals, and refund the unused portion of paid periods and unspent purchased Sparks.
18. Governing law, complaints and dispute resolution
18.1 Law. These Terms are governed by the laws of Portugal. If you are a consumer living in another country, you also enjoy the protection of the mandatory consumer-protection rules of that country, and nothing here deprives you of it.
18.2 Talk to us first. If something goes wrong, email [to be added]. We aim to reply within [to be added] business days and to resolve complaints within 15 business days.
18.3 Complaints book (Portugal). You may also file a complaint through the official Portuguese electronic complaints book, Livro de Reclamações Eletrónico, at www.livroreclamacoes.pt. We respond to complaints filed there within the legal deadline.
18.4 Out-of-court dispute resolution. Under Portuguese law (Lei 24/96, art. 14, as amended by Lei 63/2019), consumer disputes of up to EUR 5,000 may, at the consumer's choice, be submitted to a consumer arbitration centre, and we are then bound to take part. The national centre for disputes that have no local centre is CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt). Consumers living in other EU countries may also contact their local European Consumer Centre (ECC-Net).
18.5 Courts. Subject to the mandatory rules that let consumers sue and be sued in the courts of their own country, the courts of [to be added], Portugal, have jurisdiction.
19. General
19.1 Assignment. You may not transfer your rights under these Terms. We may transfer our rights and obligations to a successor in business (for example, if the sole-trader business is incorporated or sold), provided this does not reduce your rights; we will notify you.
19.2 Entire agreement; severability; no waiver. These Terms and the documents they reference are the whole agreement between us about the Service. If any clause is found invalid, the rest remains in force and the clause is replaced by a valid one that comes closest to its purpose. Our failure to enforce a clause is not a waiver.
19.3 Force majeure. Neither of us is liable for failures caused by events beyond our reasonable control, including outages of third-party AI, cloud or payment providers, except that you remain entitled to the remedies the law gives consumers.
